Terms of Service

1. Scope of Services

Boosted Experience Limited provides Customer Experience (CX) and Employee Engagement solutions, including but not limited to:

  • Customer Voice Drive
  • Rise & Perform
  • Designing Smiles
  • Connecting Horizons
  • Consulting, dashboards, analytics, QR-code systems, training, and software integrations

All deliverables are described in the service proposal or purchase order accepted by the Client.

2. Payment Terms

2.1 Billing Cycle
Invoices are issued monthly and payable no later than the 15th of each month.

2.2 Late or Failed Payment
If payment is not received by the 15th:

  • A reminder will be issued immediately.
  • A late fee of 5% of the monthly invoice may be applied.
  • Services may be suspended automatically on the 16th until settlement is received.
  • Access to dashboards, forms, live notifications, and support will be paused during suspension.

2.3 Annual or Setup Fees

  • Setup and one-off fees are non-refundable and payable upfront.

3. Suspension & Termination Policy

3.1 Suspension
Boosted Experience Limited reserves the right to suspend part or all Services when:

  • Payment has not been made by the due date
  • The Client breaches any material clause of these Terms
  • The Client misuses the system or breaches data privacy obligations

3.2 Termination

  • Either party may terminate with 30 days’ written notice.
  • All outstanding balances remain payable immediately upon termination.

4. Data Protection & GDPR

Boosted Experience Limited complies with the Mauritius Data Protection Act, GDPR, and recognised international data standards.

4.1 Data Processing

  • Boosted operates as Data Processor for Client data collected through forms, dashboards, QR codes, surveys, and evaluations.
  • The Client remains the Data Controller.

4.2 Data Usage

  • Data is processed solely for service delivery, analytics, and improvement.
  • No personal data is sold, shared, or used for unrelated purposes.
  • Access is restricted to authorised personnel only.

4.3 Data Storage & Security

  • Data is stored on secure, encrypted servers.
  • Regular security reviews, access controls, and backups are maintained.
  • In case of any breach, the Client will be notified within 72 hours.

4.4 Data Retention

  • Data is retained only for the duration of the contract unless otherwise required by law.

4.5 Data Subject Rights

End-users may request access, correction, deletion, or portability of their personal data.

5. Confidentiality & NDA

Both parties agree to a strict Non-Disclosure Agreement (NDA):

5.1 Confidential Information

  • Includes all business information, data, strategies, customer insights, dashboards, formulas, templates, and materials shared by either party.

5.2 Obligations

  • Information must be protected and not disclosed to third parties without written consent.
  • Confidentiality obligations survive contract termination.

6. Intellectual Property

  • All proprietary tools, dashboards, code, templates, automation scripts, and methodologies created by Boosted Experience Limited remain the exclusive intellectual property of the Provider.
  • The Client receives a licence to use them solely for the duration of the service agreement.

7. Responsibilities of the Client

The Client agrees to:

  • Provide accurate and timely information required for service delivery
  • Ensure internal compliance with data protection laws
  • Use the Services ethically and legally
  • Ensure QR code placements, communications, and forms respect property and regulatory requirements

8. Service Levels & Support

Boosted Experience Limited aims to provide the highest service quality with:

  • Regular updates
  • Technical support
  • Monthly business review meetings (when included in the plan)
  • System monitoring and maintenance
  • Service interruptions may occur during planned maintenance or force majeure events.

9. Limitation of Liability

Boosted Experience Limited is not liable for:

  • Losses caused by misuse of the platform
  • Issues arising from third-party systems, networks, or hardware
  • Indirect or consequential damages such as lost profits

10. Governing Law

  • These Terms are governed by the laws of the Republic of Mauritius.
  • Any dispute shall be settled before competent courts in Mauritius.
